The registered user who completes the subscription purchase on the Platform. The Buyer's identity, contact, and billing information is as provided during the registration and checkout process.
This Distance Sales Agreement ("Agreement") is executed in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts. The subject of this Agreement is the determination of the rights and obligations of the Parties regarding the sale and delivery of the AI-powered content creation SaaS subscription service ("Service") offered by the Seller to the Buyer through the Platform.
The details of the Service are as follows:
The Service is activated immediately upon successful payment processing. The Buyer acknowledges that access to the Platform and its features is contingent upon active subscription status and successful payment.
In the event that an unauthorized credit or debit card is used for payment, or if a payment is disputed or reversed without legitimate cause, the Company reserves the right to immediately suspend or terminate the Buyer's account and access to the Service without prior notice.
Pursuant to Article 15(g) of the Regulation on Distance Contracts dated 27.11.2014 and the Consumer Protection Law No. 6502, the right of withdrawal does not apply to contracts for the delivery of digital content that is not supplied on a tangible medium, once the performance has begun with the consumer's prior express consent and acknowledgment that they will lose their right of withdrawal.
As the Service is a digital SaaS product that is activated and delivered immediately upon payment, the Buyer expressly consents to the immediate commencement of the Service and acknowledges that the right of withdrawal is waived upon activation.
Notwithstanding the above, SwiftAd.ai may, at its sole discretion, offer a refund to users who request cancellation within the first 3 to 7 calendar days of their initial subscription, provided that the Service has not been substantially used. This optional refund policy is a goodwill gesture and does not constitute a legal obligation.
Refund Requests: To request a refund, you must create a support ticket through the Support section of your account. Refund requests submitted via other channels (email, phone, etc.) will not be processed. Our team will review your request and respond within 3 business days.
The Buyer may cancel their subscription at any time through the account settings page on the Platform. Cancellation will take effect at the end of the current billing period. The Buyer will retain access to the Service until the end of the paid billing cycle.
No pro-rata refunds will be issued for the remaining unused portion of the current billing period upon cancellation.
In the event of any dispute arising from this Agreement, the Buyer may apply to the Consumer Arbitration Boards (Tuketici Hakem Heyetleri) for disputes below the monetary thresholds established by applicable legislation.
For disputes exceeding the arbitration board thresholds, the Istanbul Courts and Enforcement Offices shall have exclusive jurisdiction.
This Agreement becomes effective upon the Buyer's completion of the payment process. By proceeding with payment, the Buyer acknowledges that they have read, understood, and accepted all terms and conditions set forth in this Agreement.
